The Malawi first magistrate court in Nkhata bay has sentenced a 35 year old Justine Mfune to 14 years imprisonment with hard labor for defiling a nine year old girl.

Government prosecutors testified to court that Mfune was caught defiling the minor in a certain maize garden within Mkondezi area in the district.
On his part, Mfune pleaded guilty to the offence but claimed that it was due the influence of alcohol.
He maintained that without alcohol, he wouldn’t have defiled a nine year old girl because he already has a very beautiful wife, who usually satisfies him in bed.
“I did that under the influence of alcohol but without that I would not have done that,” said Mfune.
But passing judgment, Magistrate Billy Ngosi brushed that aside and slapped Mfune with a 14 year jail term on grounds that a drunkard would not have thought of taking the little girl and defiling her in a maize field.
Ngosi further said he ruled in such a way because defilement cases are becoming rampant not only in Nkhata bay but throughout Malawi.
“I hope this will deter the would-be offenders on related cases,” said Ngosi when he delivered his ruling.
In litigation, Mfune asked for a fair sentence because he takes care of his family and that he is a first offender.
But his litigation did not change the judgment because Ngosi emphasized that the convict deserved a life imprisonment.
The convict hails from Yawonga village, Paramount chief Chikulamayembe in Rumphi district.
