History has been made that the law does not see the age when being applied. This was witnessed when Machinga First Grade Court slapped a 72 year old man with light labor for raping 4 year old girl.
Machinga Police publicist, Davie Sulumba confirmed about the arrest and subsequent sentencing. “Yes, it’s true. Machinga First Grade Magistrate sitting at Liwonde court on September 01, 2017 convicted and sentenced Robert Kafantaye, aged 72 to 14 years imprisonment with light labor for raping his 4 year old granddaughter. This is contrary to section 138 of the Penal Code.” said Sulumba.
In court, the Prosecutor Inspector, Richard Kandeya based at Nselema Police, told the court that the victim stays with her mother just 20 meters away from the house of her grandparents.
On August 22, 2017, the grandmother to the victim noticed that the victim had difficulties in walking, she asked her what the problem was but the victim did not disclose. Then on August 23, 2017 during evening hours, the victim started crying when she was coming from the toilet, that was when she revealed that she was feeling pain in her private part and that blood was oozing from her genital. She further revealed that she had been raped by her grandfather.
The victim narrated that the suspect drugged her into his house and they had forced carnal knowledge twice. When the matter was reported to Nselema Police, the victim was furnished with medical report for medical treatment and examination at Chikweo Health Centre where it was proved that the victim was indeed raped.
During court proceedings the accused pleaded guilty and asked the court for fair punishment considering his old age. Prosecutor Kandeya further asked the magistrate to impose a stiffer punishment to the convict regarding the nature of the offence and that such cases are common in the area.
When passing judgement, His Worship First Grade Magistrate Jones Masula concurred with the state and added that the convict traumatized the victim. He added that at his age he was not supposed to do such things. The Magistrate showed his leniency by sentencing him to 14 years imprisonment with light labor.
Kafantaye hails from Nantunga village Traditional Authority Chikweo in Machinga District.
